I  tried you patch and had problems.
What is this meant to be a patch to?

I tried patching 2.6.32.7 and got a number of errors from patch like:

    Reversed (or previously applied) patch detected!  Assume -R? [n]
    20 out of 20 hunks ignored -- saving rejects to file 
drivers/char/n_tty.c.rej

    (and more)

perhaps you can provide a patch to a current kernel.
